            Delegate Lane moved to amend the Committee Substitute by striking everything after the enacting clause and inserting in lieu thereof the following:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated as §3-10-4a, all to read as follows:

ARTICLE 10. FILLING VACANCIES.

§3-10-4a. Federal officeholders; constructive resignation.

            Notwithstanding any provision of this code to the contrary, no person who holds any Federal public office is eligible to be a candidate for another elected office, if the election of such person would create a vacancy in the office already held.
